India ripe for a Political Revolution: Justice Katju

School of Law, Ansal University inaugurated its first ‘Tiffin Talk’ session on Monday 20th February, 2017 with Justice Markandey Katju as the Chief Guest. ‘Tiffin Talk,’ an intellectual knowledge sharing platform involving eminent public intellectuals as speakers, is a flagship academic outreach initiative of School of Law. Justice Katju while speaking on the occasion highlighted the inadequacies plaguing various public institutions including political apathy towards reform. He was quite vocal as he criticized the political system especially politicians for engaging in selfish activities. He urged the youth to change the system by initiating a political revolution in the larger interest of the country.  The existing system is corrupt and beyond reform according Justice Katju. Urging the youth to take the reigns of the system as torchbearers of the future, Justice Katju reminded the audience about the need for pressing reform and the significance of youthful activism and leadership. India, according to Justice Katju is ripe for a political revolution that can potentially alter the status quo for the better. The Talk was attended by Dr. Kamlesh Misra (Vice-Chancellor, Ansal University), Dr. M.K. Vajpayee (Registrar) and Dr. Sanoj Rajan (Dean, School of Law). The ‘Tiffin Talk’ session was followed by a lively question answer session which saw Justice Katju answering various thought provoking questions put forth by students. Pursuant to the same, Justice Katju inaugurated, the “Hall of Justice”, the newly constructed School of Law’s Moot Court Hall slated to be the venue for the 1st Ansal University Moot Court Competition to be held from April 7th-9th, 2017.

IJLI is a blind peer reviewed quarterly publication which focuses on all aspects of Law and a multiple variety of disciplines ranging from Articles, Notes & Comments and Legislative Briefs on contemporary issues related to the fields of economics, social and legal sciences and all other forms of academic writing. IJLI is the first online law journal in India which has been indexed in 10 internationally recognized indexing platforms which let the manuscripts to be indexed and accessed globally. Contribution Guidelines:- Author(s) may submit under any of the following categories:
  • Articles (4000 to 6000 words) - An article must completely analyse the issue that the author seeks to highlight. We intend to incorporate critical analysis and original assertions on the said issue.
  • Notes (2500 to 4000 words) - A note should include condensed study in the contemporary legal issue. The nature of the writing should preferably include descriptive analysis and informed comments on any new ideas and perspectives.
  • Case Commentaries (1000 to 3000 words) - A Case comment should include interpretation of any landmark judicial pronouncement in any contemporary legal issue.
  • Legislative Briefs (1000 to 2500 words) - A Legislative brief seek to determine the implication of any existing or proposed Indian legislation (both Central/State). One can also focus on any specific section/s or present an overview of the legislation.
Note: All the word limits mentioned above are inclusive of footnotes. Please note that the word limits will be strictly enforced. Submission Guidelines:
  • All manuscript must be accompanied by an abstract not exceeding 200 words.
  • The body of the manuscript should be in Times New Roman, Font Size 12 and in 1.5 line spacing, the text should be justified and a margin of 2.54 centimeters shall be left on all sides of the paper, the footnotes should be in Times New Roman, Font Size 10 and in single line spacing. End notes are not to be used. The Harvard Bluebook, 19th edition is the style which is to be strictly adhered to for citations.
  • Submissions must be made via e-mail to Editor-in-Chief of IJLI at editor@ijli.in. Submissions must be made in the MS Word (.doc/.docx) format. The subject of the e-mail should be “Submission_Articles/Notes/Case Commentaries/ Legislative Briefs.”
  • Submissions must be made latest by March 15, 2017.
  • Co-authorship is permissible up to a maximum of two authors and two separate certificates shall be issued.
  • The manuscript must be an original and unpublished work. The authors must also confirm that the manuscript is not being considered for publication elsewhere.

Simran SahniThe third weekend (17th, 18th and 19th February) of February was buzzing with energy, enthusiasm and passion at Symbiosis Law School, Noida. “SymFiesta 2017: For the Wanderlust in Heart” – It was about three days, three nights , twenty seven events and countless memories- a journey around the world in 72 hours packed with excitement, thrill, perfection and immense satisfaction, with students participating from over 60 colleges pan India. SymFiesta’17 was powered by Tittle Sponsor- Sanskriti Avass and Co-Tittle Sponsor- Teemac, Associate Sponsors- Sadgamaya, Khaitan, Legal Associates and Gift Partner- MyLaw.net. The event hosted over 4,000 persons participating in more than twenty-five competitions and the three dazzling nights. SymFiesta’17 hosted five flagship events- Fashion Show (SymVogue), Group Dance (Anukriti), K.T.S. Tulsi Mock Trial, Battle of Bands (Armageddon) and Parliamentary Debate (Confero). Over 20 other cultural, literary, legal and miscellaneous events were organised, with prizes worth Rs. 20 lakhs awarded to the winners. The three nights witnessed sensational performances by 5 renowned bands, 3 DJs, and 2 stand-up comedians. The inaugural day, February 17, had an unbeatable line up of the bands for Battle of Bands (Armageddon) followed by performances by famed bands like the Praarambh- The Story Begins, Indie Trigg, Apricot and Error. Solo Singing (Symphony), Shuttermania (Photography Competition), Client Counselling, Judgement Writing and Parliamentary Debate (Confero) gave a cultural flare and intellectual touch to the first day of the fest. The day kicked off with the final rounds of Negotiations and Client Counselling. The semi-final and final rounds of K.T.S. Tulsi Mock Trial. The Final Round of this event was judged by none other than Mr. K.T.S. Tulsi himself. Other judges of the legal events included Mr Purvish Malkhan (AOR), Mr Ankur Kashyap, Mr Utkarsh Tiwari, Mr Natraajan Swaminathan, Mr Manish Lamba (Legal Counsel, Bharti Realty), Mr Pulin Kumar (Legal Counsel, Adidas), Mr Manoj Kumar, Mr Yogesh Wadhwa (GC, General Motors), Mr Anupam Lal Das (AOR) and Mr Rajiv Arora (Legal Counsel, Airtel). This was followed by the glamorous Fashion Show (SymVogue). The Pro Night was where the two amazing Stand-up comedians from East India Comedy- Sapan Verma and Sahil Shah followed by a soulful and mind blowing performance by Nikhil D'Souza and his band. The faculty along with an overjoyed Organizing Committee declared 16-17-18 February, 2018 as the official dates for SymFiesta’s next edition.

ILNU: Ensuring Victim Participation In Criminal Justice System

Simran Sahni Institute of law, Nirma University is organizing the Sixth International and Tenth Biennial Conference of The Indian Society of Victimology from February 23-25, 2017 on the broad theme Ensuring Victim participation in Criminal Justice System, with the aim of encouraging research in bringing out the synergy involved in the collaboration between multiple disciplines of Victimology. On the inauguration of the three day conference, eminent dignitaries such as Prof. (Dr.) G. S. Bajpai, President, Indian Society of Victimology & Registrar, National Law University, Delhi, Professor Dr. M Priyamvadha, General Secretary, Indian Society of Victimology, Dr. A.K. Singh, Commissioner of Police, Ahmedabad, Dr. Anup K. Singh, Director General, Nirma University graced the Institute with their presence. Hon’ble Mr. Justice Mohan Pieris, Former Chief Justice and Attorney General of Sri Lanka was the Chief Guest of the event and the guest of Honor was Hon’ble Mr. Justice Bhagwati Prasad, Chairperson, Gujarat State Human Rights Commission. Mr. Justice Mohan Pieris gave a much focused opinion on victimology in his speech and posed a question that have we made victimology a very complex and difficult field by making it a science like biology. He also tried to invoke a discussion by asking “Why does the society have a differential attitude towards the victims? Justice Bhagwati talked about how bad the conditions of the accused in the prison is, "Please don't go to police stations, it is not a good place for the lawyers to view with regard to the treatment of the accused, we find ourselves asking, now who is the real victim?" he exclaimed. In the end he also said that these days the practice of accusing the victim is very prevalent, for instance the act of telling a girl that because she wore a short dress, she was raped is wrong. Instead of adding on to the trauma of the victim, we must sympathize to such limit as to provide them with justice. Next Prof. K. Chockalingam Award Oration ceremony was conducted in which Prof. N.K. Chakrabarti, Dr. R.N. Mangoli and Dr. Ina were awarded. Vote of thanks was given by Dr. Krishna Pal Malik, Associate Professor, ILNU.

NLIU – Trilegal Summit on Mergers and Acquisitions

Simran Sahni The Centre for Business and Commercial Laws (CBCL) of the National Law Institute University, Bhopal in collaboration with Trilegal, is organizing the second edition of NLIU-Trilegal Summit on Mergers and Acquisitions on 26th February, 2017. It aims at going beyond the letter of law in the analysis of M&A transactions, along with discussing the same with the industry stalwarts. There has been an enormous increase in demand for corporate lawyers deft at M&A negotiations and transactions as scope for M&A has increased massively with further liberalization of the FDI policy. Therefore, to keep up with the need of the hour, NLIU has stepped up its promotion of work in commercial laws in the past few years and the Summit was conceptualised to compensate for the lack of dedicated modules on M&A in legal courseware in colleges. The Summit aims to bring together the best talent from top law colleges of the country and provide a platform to discuss M&A issues with peers as well as an interactive panel of judges comprising partners from the collaborating firm, Trilegal, academicians and in-house counsels will be held after the each presentation. The panel will also feature members from the Competition Commission of India. The Summit will witness sixteen paper presentations from various law colleges all over India discussing Mergers and Acquisitions, within the contours of the sub-themes, in light of the relevant legal provisions. The top sixeen submissions from both categories have been published in a limited edition book commemorating the Summit. The Cell has been extremely active in the buildup to the event. The Facebook page, especially, has seen regular updates on M&A transactions including Yahoo-Verizon, Sony Pictures-Ten Sports, and Microsoft-LinkedIn. Detailed yet simple explanations of these deals have been provided on the page, along with interactive videos elaborating the basics of M&A. This is the second edition of the event, with the first in 2016 having been a resounding success. NLIU Trilegal Summit: First and Second Session Concluded

Aishwarya DhakareyThe NLIU Trilegal Summit began with traditional lighting of the ceremonial lamp accompanied by an address by Prof. Dr. S. S. Singh, Director, NLIU .  Trilegal partners Sitesh Mukherjee and Yogesh Singh also addressed the gathering, throwing light on the wide spectrum of areas M&A transactions influence upon. The first session began with the first paper presentation by Symbiosis Law School, Pune. The panelists comprised Yogesh Singh, Rakesh Kumar, Nandan Kumar, Sanjay Yadav, Sitesh Mukherjee, and Krati Rajoria. The speaker put his analysis to the phenomenon of strict Anti-Trust regimes in USA, China, UK and South Africa, and measures to facilitate mergers in such scenarios. The second paper was presented by Shally Nain from RMNLU Lucknow. She brought up the issues of extra territoriality and multiple jurisdictions, which the panelists found innovative. Delays in mergers due to lack of international coordination were highlighted, accompanied by suggestions for tackling the same. The terms of M&A and cross border acquisitions were defined by A.R.Poorvaja from TNNLS in her presentation. Moreover, she dealt with different taxation rates for different categories of mergers. Dimple Singh and Shreya Agrawal from Symbiosis Law School Pune elaborated upon the continuous change in FDI policies and the implementation of GST, which has made investing a risky game. Accordingly, taxation for cross-border mergers is still shaky, with no provisions governing it. Jithin Jackson from TNNLS made a strong pitch for universal banking, stating that is reduces average costs, facilitates better flow of information, integrates financial activities and reduces intermediaries. He further spoke about the barriers that prevent Indian banks from going international. The interactive Q & A sessions were also featured in this session.  

NLIU-Trilegal Summit: Winners announced

Aishwarya DhakareySession 3 of the NLIU-Trilegal summit began soon after the lunch. Apoorva Vishnoi and Ayushi Sinha from RGNUL Patiala presented a paper on crowd funding. They criticized SEBI's policy of no relaxation in regulatory framework for crowd funding companies. Harshit Singh and Amay Jain from Nirma University tackled post-merger implementation, referring to Air India and Indian Airlines among others. Masala Bonds were dealt with by Rohan Kohli and Arshia Verma from NLIU Bhopal, with emphasis on the Sahu Committee’s recommendation. They made a strong case for usage of green masala bonds by companies to fulfill their CSR requirements. Rubanya Nanda from DSNLU, Vizag dealt with the question of who can be an expert. In the conflict between the ambit of expert determination and arbitration tribunal, arbitration proves to be conducive and time saving is what her she vouched for. Shubhi Bhandari and Rohini Dayalan from NLIU, Bhopal presented next with a contemporary case study of RCom and SSTL. It was an interactive session overall, with questions being asked by the panelists as well as the audience. Valedictory The CCI members addressed the audience, expressing their appreciation for the organizing committee and the quality of the papers presented. HNLU Colossus, 2017 Concludes

Simran SahniColossus 2017, the annual sports, cultural and literary fest of the Hidayatullah National Law University, concluded on the 26th February, 2017 with a valedictory ceremony in august presence of Mr. Sonmoni Borah, Secreatary, Department of Sports and Youth Welfare and Department of Social Welfare and Hon’ble Vice Chancellor of the University. More than 700 participants, marked their presence at the event spanning 30 universities and colleges across India. The three day long fest started on the 24th of February in the presence of Mr. Derk Segaar, Director, UN Information Centre for India and Bhutan, chief guest for the occasion. He stressed on the Sustainable Development Programme and vision 2030, and India’s role in it especially with reference to peace and conflict, big mega trends like food-safety, over population, migration etc. Hon’ble Vice Chancellor Prof. (Dr.) Sukh Pal Singh, stressed on the importance of extra-curricular activities and described Colossus as a platform provided by University to develop over all personality which is required for the excellence in life. “Education is a weapon to change the world and it is the way to develop the sense of brotherhood” he stated. The fest was a three day event which also included the 2nd edition of HNLU International Model United Nations. The delegates deliberated on national as well as international issues ranging from the recent demonetization move at the National level to the Syrian Crisis at the international level. The most innovative part of the IMUNC was the introduction of UNICEF committee in which 30 specially-abled participants deliberated on the agenda of ‘Inclusion of Children with Disability in Policy Formulation’. It is noteworthy that this inclusion of specially-abled children in any conference has happened for the first time in the history of MUNs in India. This idea being conceptualised by the Hon’ble Vice Chancellor Prof. (Dr.) Sukh Pal Singh, has been appreciated not only in India but abroad as well. Hon’ble Vice Chancellor also assured them to convey their suggestions to the Government of Chhattisgarh. Another attraction of Colossus 2017 was the Stand-up by Shivam, Himanshu Uikey along with a rib-tickling host performance by Shreyas Negi. IDIA, the CLAT trainer for the economically weaker students had set up a stall with the help of its student volunteers at HNLU, who served different dishes, the profits of which they would donate to IDIA fund for weaker students. Battle of Bands, was judged by Mr. Rohit Lalwani of ‘Lal and the People’ and was won by the band ‘Brazen Molok. Hemant Vishwakarma emerged as the champion of the Solo Dancing category whereas the group category was won by the team from JNM Medical College. In the Solo Music singing event, Pratik Hola of JLU Bhopal bagged the first prize. The second day of Colossus 2017 concluded with a mesmerizing performance by Coke Studio featuring the famous band ‘Parvaaz’ which was given an opening score by the band ‘Lal and the People’.                                                                     The third and the last day of the fest finally concluded with a valedictory ceremony on Sunday, the 26th of February, 2017 in the august presence of Mr. Sonmoni Borah, Secreatary, Department of Sports and Youth Welfare and Department of Social Welfare and Hon’ble Vice Chancellor of the University, who observed the importance of Sports and Cultural activities important for the physical and mental well being of human being and said that, “healthy mind resides in healthy body and such activities are the best way to achieve this.” He also added that we have started saying only “beti bachao, beti padhao” but we should also focus on “beti khelao”. From the Sports Events: In LAN gaming, Counter Strike and NFS Most Wanted was won by the team from IIIT, FIFA was conquered by Mr. Elvis Joseph of AIIMS Raipur whereas the prize for Mini Militia, the mobile gaming event, was won by HNLU’s home team. The hosts HNLU emerged victorious in Tennis Singles, where Devanshu Jain secured the first position. Team events of Basketball and Carrom were also won by the university. JLU Bhopal secured the first position in Football, Cricket was won by MATS University whereas CSVTU Bhilai emerged as winners in Volleyball, defeating HNLU. Poonam Mangalani of Kalinga University displaying her exceptional athletic endurance, secured the first positions in Shot Put, Discuss Throw, Javelin throw, and Hammer Throw. Monika Netam of BIT Durg grabbed the first prize in 100 mtr race. 200 mtr race was won by Megha of HNLU whereas 400 mtr was won by Asha Singh of GEC Raipur. HNLU’s girls brought accolades in Table Tennis Girls singles and doubles as well as Lawn Tennis Women’s Doubles winning them with remarkable margins. In the fashion show, team comprising of Namrata Patil, Sapna Pattely and Kriti Mourya of Kruti Institute grabbed the first position. The DJ Night by DJ Akbar Sami was the main attraction of the third day which was a perfect end to what has been a fantastic three day event that was Colossus 2017.

The Moot Problem for this Round will be the same as that for the Regional Rounds. The last date for registration for the National Funding Round on a provisional basis is March 15, 2017. Please note that a team is required to be registered for the International Rounds for being eligible to participate in the National Funding Round. The Official Rules of the National Rounds have been released. All details, including the Moot Problem and the registration form are available for download. This debate exemplifies the constant endeavor of the nearly century old institution to provide a platform for diverse views on contemporary social and legal issues, helping to understand society and its evolution, thereby maintaining the spirit of dynamism. Format for the Debate: Round 1: Preliminary Selection Process Students are required to submit a 500 word abstract, which is to be accompanied by a two minute video recording of the same. They can decide to take a position either For the Motion or Against the Motion. The abstract should clearly indicate the side chosen by the participant and reflect a view consistent with it.
